These Terms of Service ("Terms") govern your access to and use of Manaplane LLC's website, manaplane.com (the "Site"). By accessing or using the Site, you agree to be legally bound by these Terms. If you do not agree to these Terms, you may not use the Site.
You must be at least 13 years of age to use the Site. If you are under 18 years of age, you must have your parent or legal guardian's permission to use the Site and agree to these Terms. By using the Site, you represent and warrant that you meet these age requirements.
We comply with the Children's Online Privacy Protection Act (COPPA) and do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete that information as quickly as possible. By submitting User Content, you grant Manaplane a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and promoting the Site.
Content Standards: You represent and warrant that your User Content does not violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights. You are solely responsible for your User Content and any consequences of posting or publishing it.
Content Moderation: We reserve the right, but have no obligation, to monitor, edit, or remove User Content that we determine violates these Terms or is otherwise objectionable. We may terminate accounts of users who repeatedly infringe on the intellectual property rights of others.
DMCA Compliance: If you believe that content on the Site infringes your copyright, please contact us at [email protected] with a detailed description of the alleged infringement, including the location of the content and your contact information.

No Uptime Guarantee: We do not guarantee that the Site will be available at all times or that it will be error-free. The Site may be unavailable due to maintenance, technical issues, or other circumstances beyond our control.
Service Discontinuation: In the event we permanently discontinue the Site, we will provide at least 60 days' notice and offer you the opportunity to export your deck lists and other user data in a common format (such as CSV or JSON). This notice will be provided via email to your registered email address.
The Site may contain links to third-party websites or services, including Scryfall, EDHREC, and others. We are not responsible for their content, privacy policies, or practices. These links do not imply endorsement, and your use of third-party sites is subject to their respective terms and policies. We encourage you to review the terms and privacy policies of any third-party sites you visit.
The Site is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not guarantee uninterrupted access, accuracy of information, or that the Site will be free from errors, viruses, or other harmful components.
Data Loss: We are not responsible for any loss of data, including deck lists or user content, whether due to technical failures, security breaches, or service discontinuation. You are solely responsible for backing up any important data.
Limitation of Liability: To the fullest extent permitted by law, Manaplane, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from your use of or inability to use the Site. Our total liability for any claims arising out of or relating to these Terms or the Site shall not exceed $100 or the amount you paid to use the Site in the 12 months preceding the claim, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
We reserve the right to terminate or suspend your access to the Site at our sole discretion, without notice or liability, for conduct that we believe violates these Terms, is harmful to other users of the Site, us, or third parties, or for any other reason, including but not limited to extended periods of inactivity.
Upon termination, your right to use the Site will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.
Informal Resolution: Before filing a claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 60 days of submission, you or Manaplane may bring a formal proceeding.
Arbitration Agreement: You and Manaplane agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration will be conducted in Hennepin County, Minnesota, or another mutually agreed location. The arbitrator's decision will be final and binding.
Class Action Waiver: You and Manaplane agree that any proceedings to resolve disputes will be conducted on an individual basis and not as a class, consolidated, or representative action. You and Manaplane expressly waive any right to file a class action or seek relief on a class basis.
Exceptions: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights. You also retain the right to opt out of this arbitration agreement by sending written notice to us at [email protected] within 30 days of first accepting these Terms.
These Terms are governed by the laws of the State of Minnesota without regard to its conflict of law provisions. To the extent arbitration does not apply, you agree that any legal action or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Hennepin County, Minnesota, and you consent to the exclusive jurisdiction and venue of these courts.
You agree to indemnify, defend, and hold harmless Manaplane, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any rights of another party, including any other users; or (d) your User Content. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses.
The Site may be subject to U.S. export control laws and regulations. You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce. You represent and warrant that you are not located in a country that is subject to a U.S. government embargo or that has been designated by the U.S. government as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable. The failure of either party to exercise any right provided for herein shall not be deemed a waiver of that right.
These Terms, together with our Privacy Policy and any other legal notices or policies published by us on the Site, constitute the entire agreement between you and Manaplane regarding the Site and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter. No waiver, modification, or amendment of these Terms shall be effective unless in writing and signed by both parties.
You may not assign or transfer these Terms or your rights and obligations under these Terms, in whole or in part, without our prior written consent. We may assign or transfer these Terms or our rights and obligations under these Terms at any time without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.
